A. MAIN PROVISION #

Before you use your Card, please read this Agreement carefully. By using (which includes being approved with and activating) your Card, you will be considered to have accepted all the terms and conditions applicable to your Card as set out in this Agreement and will be bound by them. Use of your Card is also subject to the related provision in any additional Terms and Conditions imposed by the Company from time to time, including but not limited to the Cardholder Agreement, Privacy Policy, and any operational rules or procedures notified to you via email, in-app notification or on the lookcard.io platform. 

This Agreement applies to all kinds of credit and debit cards (“Cards”) issued or operated by Lookcard Limited and/ or its successors and assigns (“LookCard”, “We”, “Ours”, “Us”, “CamClaim Limited”, “Company”) under its/ their card schemes, and related services (including but not limited to credit and/ or facility) provided by the Company and/ or its affiliates, subsidiaries, associated entities and any of their branches and offices (together or individually) to you as holder of the Card.

For the avoidance of doubt, the Card (as defined below) contemplated to be issued to you will be issued by CamClaim, but not LookCard. Save as expressly provided hereunder, LookCard has no role in the issuance of the Card but handling day to day operations for the card. LookCard does not act as agent or principal of CamClaim in relation thereto.

Notwithstanding you may apply for the Card at or through the WebApp of LookCard, you further agree and acknowledge that LookCard shall have no obligation or liability whatsoever in procuring LookCard to perform under and/ or comply with the terms and conditions of this Agreement.

B. CONDITIONS FOR USE #

  1. ELIGIBILITY
    We reserve the right to (i) reject your application or terminate your access to the LookCard and/ or associated account if you fail to meet the criteria below, or (ii) amend the eligibility criteria at our sole discretion without prior notice. By applying for and using a LookCard, you confirm that: 
    • You are at least eighteen (18) years old.
    • You meet the verification and onboarding requirements and are eligible to register for and use the LookCard and its linked account.
    • You possess full legal capacity and authority to enter into this agreement.
    • You are not impersonating another individual or concealing your identity. 

  2. VERIFICATION AND PERSONAL DATA 
    • You agree to complete all KYC (Know Your Customer) procedures, including identity verification, anti-money laundering, and counter-terrorism checks, as required under our compliance policy and relevant legal regulations.
    • You agree to provide accurate and complete KYC documentation upon request. You authorize LookCard to collect and process your personal data solely for verification and compliance purposes.
    • You represent and warrant that you have full authority to provide any submitted KYC information. 
    • We reserve the right to decline or terminate your card and/or account access if: 
      • KYC documents are not submitted
      • Information submitted is inaccurate or incomplete
      • We are unable to verify your identity
      • We suspect misuse or fraudulent activity involving your card or account

  3. PERSONAL DATA HANDLING 
    Your personal data will be collected, processed, and utilized in accordance with LookCard’s Privacy Policy, which is available within the official website. This includes data collected during card issuance, use, and account maintenance. 

  4. UPDATING PERSONAL INFORMATION 
    You must ensure that all submitted information, including KYC, remains accurate and current. Prompt updates must be reported via our Customer Support team. We are not liable for any service failures resulting from outdated or incorrect data. 

  5. CONSENT FOR DATA COLLECTION 
    By using LookCard, you irrevocably consent to the collection, use, processing, and storage of your personally identifiable and financial information, including KYC data. Such information may be shared with our card issuer, affiliated companies, financial institutions, and regulated service providers solely for operational, legal, or compliance purposes. 

C. CARD USAGE #

  1. TYPES OF CARDS OFFERED 
    LookCard offers two distinct card products: Debit Card and Credit Card. The terms of usage differ based on the card type selected during the application process: 
    • DEBIT CARD
      Operates on a prepaid basis. Transactions are deducted from the available balance that the user has topped up in advance. 
    • CREDIT CARD: 
      Operates as a secured/ collateralized credit card with a pre-established credit limit backed by a refundable secured deposit. Transactions are made on credit, and repayment is required on a monthly basis. 
    • By activating and using either card, you agree to adhere to the specific usage terms applicable to that card type, as outlined below. 

  2. DEBIT CARD 
    • NATURE OF THE CARD 
      • Your Card is not a credit card and does not offer a credit facility. It operates as a debit card, where transactions are only permitted if sufficient funds are available in your account. Funds will be deducted from the relevant supported currency based on the top-up you have made.
      • Your Card is denominated in United States Dollars (USD). All transactions, regardless of the currency in which they are made, will be processed and settled in USD. The following conditions apply:
        • You may use your Card to make purchases in any currency accepted by the merchant.
        • Transactions made in a currency other than USD will be automatically converted to USD at the applicable exchange rate determined at the time of the transaction using Visa rate.
        • The USD equivalent of the transaction amount will be directly deducted from your available card balance.
        • You are responsible for ensuring that your Card has sufficient USD balance to cover the converted transaction amount.
        • You are required to activate your Card and top it up before making any purchases. Once activated and funded, the Card may be used to purchase goods and services from any merchant that accepts Visa worldwide.

           
    • ACCOUNT NATURE 
      The Account linked to your Card is not a savings or checking account and does not earn interest on any stored balance. Additionally, your funds will not be used by the Company for investment or lending purposes.

    • TOP-UP YOUR ACCOUNT 
      You may top up your Account using supported currencies via the WebApp. Once the top up is successful, you will receive a notification email from the Company.

      Please note that a minimum initial deposit of USD 200 is required to activate your account. This amount is entirely available for spending — there are no activation fees, no card application fees, and no administrative deposit charges.

      If your application is unsuccessful after a successful deposit, the full deposit amount will be refunded to you in full.

      Subsequent top-ups may be made in any amount, subject to the applicable terms and conditions.

    • CARD SECURITY 
      • PIN ACTIVATION 
        To activate your physical card, you must log in to your LOOKCARD.IO Web App and follow the instructions and activate the card using the PIN written in your welcome kit, followed by setting a new PIN. You are solely responsible for maintaining the confidentiality and security of your PIN and any access credentials associated with your Account. If your PIN is compromised or your card is lost, you must contact Customer Support immediately and follow the required procedures.  

      • PIN AND PASSWORD PROTECTION 
        Your Card and the linked account are for your personal use only and may be used after the card is activated. You are responsible for maintaining the confidentiality of your PIN and password. You must not: 
        • Write down or share your PIN or password 
        • Allow others to view your PIN or password 
        • Store your PIN or password in identifiable formats 
        • Disclose your credentials to others 
        • Store your PIN/password together with your card or on mobile devices

      • If you forget your password or suspect any unauthorized access, you should contact Customer Support immediately. You can reset your password through the WebApp at any time. 

    • USE OF ACCOUNT 
      You, as the cardholder, are the sole authorized user of the Card and the associated Account. The Card may be used to access your available balance and make purchases from any merchant worldwide that accepts Visa. 

      Please note: 
      • Transactions are only permitted when your Account has a positive balance
      • Transactions will not be authorized if the amount exceeds your available balance. 
      • Upon each transaction, your Card will be immediately debited for the transaction amount along with any applicable fees or charges under these Terms. Your Account balance will be adjusted accordingly. 

    • FEES AND CHARGES 
      All fees and charges associated with the use of your Card and Account are detailed in the Fees Section of Appendix. Unless otherwise stated, applicable charges will be automatically deducted from your available balance. 

      All applicable fees, including but not limited to transaction fees, processing fees, and foreign exchange conversion fees, shall be borne by the User. Transaction fees are strictly non-refundable, irrespective of whether a transaction is completed, reversed, declined, cancelled, or refunded.

    • ERRORS AND TRANSACTION DISPUTES 
      You are responsible for maintaining and reviewing all transaction records and receipts issued by merchants. Regularly review your transaction history to verify its accuracy. The Company bears no responsibility for any failure on your part to: 
      • Reconcile or verify your transaction details;
      • Report discrepancies, errors, or unauthorized transactions within a timely manner. 
      • All transactions displayed in your account will be presumed accurate and authorized unless a written dispute is submitted within two (2) weeks from the transaction date.

    • DISPUTES REGARDING NON-DELIVERY/ UNAUTHORIZED TRANSACTIONS 
      Once a transaction is authorized and completed, it cannot be reversed or cancelled by us. If you seek a refund, you must: 
      • Contact the merchant directly 
      • Obtain a valid refund voucher from the merchant; 
      • Submit the voucher to LookCard for processing. 

        Refunds will only be credited once we have received confirmation from the merchant. All disputes regarding goods or services must be addressed directly with the merchant. 

        At our sole discretion, we may initiate a dispute with a merchant on your behalf if you submit sufficient supporting documentation, including proof of transaction and relevant details. If the merchant rules in your favor, we will credit the disputed amount to your Account in accordance with the applicable card network rules. 

    • LIMITATIONS ON USE OF YOUR ACCOUNT 
      Certain merchants (e.g., hotels, car rentals) may request an authorization hold up to 20% more than the estimated total to ensure sufficient funds. The actual amount will only be deducted once confirmed. 

      You must not use your Card or Account for the following: 
      a) Transactions with merchants that do not accept the Card
      b) Activities that:
      • Violate any applicable law; 
      • Involve prohibited goods or services; 
      • Involve sanctioned or prohibited countries or individuals; 
      • Are deemed fraudulent by government or regulatory bodies; 
      • Are used for money remittance unrelated to a goods/services transaction.

    • CARD REPLACEMENT 
      You may request a replacement for a lost, stolen, or malfunctioning card at any time by: 
      • Contacting Customer Support via available channel, or 
      • Submitting a request through email 
      • Please note that a replacement fee may apply

    • CARD EXPIRY, ACCOUNT CLOSURE, DORMANCY, TERMINATION & BALANCE RETURN 
      • CARD EXPIRY 
        Upon expiry, your Card will no longer be valid for transactions. Unless you instruct us otherwise, your Card will be automatically renewed, and any remaining balance will be transferred to the new Card. 

        If, for any reason, the renewal process cannot be completed (e.g., due to verification failure or outdated account information), we will attempt to contact you using the latest contact details on record. If we are unable to reach you within three (3) months of expiry date, the Company reserves the right to terminate your card and forfeit any remaining balance in your card (if any), subject to applicable laws and regulations. 

        Your balance will not be refunded or recoverable after such forfeiture, and the Company shall not be liable for any losses resulting from your failure to update your contact or account information in a timely manner. 

      • TERMINATE/ CANCEL YOUR CARD 
        You may terminate or cancel your Card at any time by submitting a written request to our Customer Support team via email or through the official social channel. 

        Upon cancellation: 
        • You must immediately cease all use of the Card. 
        • If you are in possession of a physical card, you must destroy it by cutting through both the chip and magnetic stripe.
        • Any remaining balance at the time of cancellation will be forfeited and will not be refunded.
        • You will remain liable for any transactions or fees incurred prior to the effective date of cancellation.

          Please note that your Account may remain active unless you also request account closure in accordance with Clause 11.L.

      •  DORMANCY
        The LookCard Lite Visa Debit Card shall be deemed dormant if no user-initiated activity is detected for a continuous period of three (3) calendar months.

        User-initiated activity includes, but is not limited to:
        • Card transactions (physical or virtual)
        • Card top-ups 

          Upon classification as dormant:
          • The user’s debit card account will be automatically terminated without further notice.
          • All remaining card balances shall be deemed forfeited and non-refundable.
          • The user shall forfeit any and all rights to future claims or recovery of forfeited funds.

            Dormant accounts terminated under this policy are not eligible for reinstatement. Users wishing to continue using LookCard services must undergo a new application and onboarding process, subject to prevailing terms and eligibility checks.

            It is the sole responsibility of the account holder to ensure continued activity on their card and associated wallet. The Company shall not be held liable for any loss incurred due to account dormancy resulting in termination and balance forfeiture.

      • CLOSING YOUR ACCOUNT 
        You may request account closure at any time and receive a refund of your available balance. You may be required to return or destroy your physical card. However, account closure is not permitted if: 
        • There is an ongoing dispute; 
        • An investigation or pending authorization is active.

    • TERMINATION OF TERMS AND CONDITIONS 
      The Company reserve the right to suspend or terminate your Account or Card immediately, without notice, if: 
      • You breach applicable laws or terms. 
      • Suspicious or illegal activity is detected. 
      • False or inaccurate KYC information is provided. 
      • Suspension is required for system updates or maintenance. 
      • Force majeure or third-party technical issues impact operations. 
      • We suspect your Account has been compromised or misused. 
      • Continued use risks breaching legal or regulatory obligations. 
      • You fail to meet eligibility criteria. 
      • There is a reasonable belief of potential financial loss to you or us. 

        In such cases: 
        • The Company reserves the right to permanently forfeit any remaining balance in your Account. No refunds will be issued, and you waive all rights to reclaim such funds, subject to applicable laws and regulatory obligations.  
        • We may report violations to relevant authorities. 
        • We are not required to disclose the rationale behind termination. 

          Additionally, we may terminate these Terms with 30 days’ written notice, at our discretion. You may terminate your Card and Account by written notice to Customer Support via email. Any clauses which should logically survive termination will remain in effect. 

D. LIMITATION ON LIABILITIES OF THE COMPANY  #

Under no circumstances shall the Company be responsible for any direct loss and liability which a Cardholder may suffer or incur as a result of or otherwise relating to any use, misuse or malfunction of his Debit Card(s) or any Debit Card services offered by the Company and except to the extent that any such loss and liability is attributable to the fraud, negligence or willful default on the part of the Company.  

Without limiting the effect of, and in addition to 11.1 above, the Company shall not be liable for:  

  • any indirect, consequential, special, punitive or incidental loss or damage arising from or in connection with the use of a Debit Card or the provision of the Debit Card services, whether or not the Company was or ought to be aware of the possibility that such loss or damage could occur;  
  • any loss or damage which a Cardholder may suffer or incur arising from or in connection with any breach of security or unauthorized use of, or corruption or transmission error associated with, his equipment or mobile device; or  
  • any event or circumstance beyond the control of the Company, including, without limitation, any governmental action, failure or malfunction of equipment, device, telecommunication network or computer systems, natural disaster, epidemics, war or strike.  
  • the refusal of any merchant, financial institution or other person to accept the Debit Card; or  
  • any defect or deficiency in goods or services obtained through the use of the Debit Card which is/are supplied by any merchant, financial institution or other person.

E. GENERAL  #

  1. PRIVACY 
    • The Company will collect, use, retain and disclose all personal data in relation to the Debit Card in compliance with the Personal Data (Privacy) Ordinance (Cap. 486 of the  Laws of Hong Kong) and in accordance with the Company’s “Privacy Policy Statement” (https://lookcard.io/en/privacy/) and/or such other document(s) issued under whatever name from time to time by the Company and certain of its related entities regarding their general policies on use, disclosure and transfer of personal data (collectively referred to as “Privacy Notices”). To the fullest extent permitted by all applicable law, each of the Cardholders:  
      • acknowledges that he has received, read and understood the contents of the Privacy Notices and agrees that the contents of the Privacy Notices shall be binding on him; and  
      • authorizes the Company to use any information it may have concerning him and his Debit Card, and/or disclose any such information to any third party (whether it is located in or outside Hong Kong) as the Company may deem necessary such as Visa and the Company’s service providers, in accordance with the Privacy Notices and/or for the provision of the Debit Card services, including, without limitation, processing the online payment(s) made by him or acting according to his instructions relating to the use of his Debit Card. 

  2. NOTICE AND COMMUNICATION
    • Without affecting other methods of communication agreed by a Cardholder, any notice, demand or other communication in respect of the Debit Cards is deemed to be received by each of the Cardholders:  
      • when posted on lookcard.io platform or the Company’s website (www.lookcard.io),  
      • when left at any of his addresses on the Company’s record, or 48 hours after mailing to such address or 7 days if the address is overseas, or  
      • when sent by electronic mail to any of his email addresses on the Company’s record. 

  3. AMENDMENT
    • The Company may (in its discretion) from time to time change, amend and/or supplement these Terms and Conditions and/or the relevant fees and charges in relation to the use of the Debit Cards provided that the Company will, where practicable, give the Cardholders not less than 30 days’ prior notice before any change of these Terms and Conditions takes effect.
    • Retention or continued use of a Debit Card after the effective date of the amendments to these Terms and Conditions and/or the relevant fees and charges shall constitute an acceptance of these amendments. 
    • If a Cardholder does not accept the proposed amendment to these Terms and Conditions, he shall notify the Company in writing and the Company may (in its discretion) terminate or suspend his Debit Card or the provision of Debit Card services in accordance with Clause 12 above.

  4. THIRD PARTY RIGHTS 
    • Subject to Clause 16.3, a person who is not a party to these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) (the “Third Parties Ordinance”) to enforce or to enjoy the benefit of any provision of these Terms and Conditions.
    • Notwithstanding any provision under these Terms and Conditions, the consent of any person who is not a party to these Terms and Conditions is not required to rescind or vary any provision hereof at any time.
    • Any director, officer, employee, affiliate or agent of the Company may, by virtue of the Third Parties Ordinance, rely on any provision hereof (including without limitation any limitation or exclusion of liability) which expressly confers rights or benefits on that person. 
  5. INTELLECTUAL PROPERTY 
    The copyright of the contents, including patents, trade secrets, trade-marks, service marks, images, graphics, logos displayed on the Debit Cards (collectively referred to as “intellectual property” in this Clause) are either owned by or licensed to the Company or the relevant third parties such as Visa and the Company’s service provider(s). No intellectual property or any part thereof is assigned or transferred to any Cardholder. Each of the Cardholders shall not use, modify, disseminate, edit, adapt or reproduce any intellectual property without prior consent of the Company and/or the relevant owners or licensees. 

  6. MISCELLANEOUS 
    • These Terms and Conditions are prepared in both English and Chinese. In case of any conflict between the English and Chinese versions, the English version shall prevail. 
    • If at any time any provision hereof becomes illegal, invalid or unenforceable in any respect, the remaining provisions hereof shall in no way be affected or impaired thereby. 
    • These Terms and Conditions shall be binding on each successor, personal representative and person lawfully acting on behalf of the Cardholder. 
    • No failure to act, omission or delay by the Company to exercise or enforce any right under any provision hereof shall operate as a waiver of such right, nor shall any single, partial or defective exercise of any right prevent any further exercise of it or the exercise of any other right.  

  7. GOVERNING LAW AND JURISDICTION 
    These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region and the Cardholder irrevocably submit to the non exclusive jurisdiction of the Hong Kong courts. 

  8. DEFINITIONS AND INTERPRETATIONS 
    Unless the context otherwise requires, the following expressions shall have the following meanings in these terms and conditions: 
“Account”Means a digital currency account wallet that holds one or more supported currencies in digital form, where the total value is maintained in an equivalent amount of United States Dollars (USD). This account may be used for card transactions, deposits, withdrawals, and other related services on the lookcard.io platform.
“ATM”Means an automated teller machine.
“Business Days”Means a day on which the Company is open for business in Hong Kong, other than Saturday, Sunday and public holiday.
“Cardholder”Means any person to whom and in whose name a Debit Card is issued.
“Debit Card”Means each LookCard Lite Visa® Debit Card issued by the Company which is linked to USD Account of Cardholder, and includes all forms of the card such as the physical card, the virtual card and any renewal of replacement card.
“Foreign Currency”Means any lawful currency issued by the government of a jurisdiction other than HKD.
“Hong Kong”Means the Hong Kong Special Administrative Region of the People’s Republic of China.
“PIN”Means in relation to a physical Debit Card, the personal identification number required to gain access to the card services.
“Privacy Policy”Has the meaning given in Clause 6 above.
“Terms and Conditions”Means the LookCard Lite Visa® Debit Card Terms and Conditions, as amended and supplemented by the Company from time to time.
